Abstract/Notes Failure to obtain the informed consent of your patient for a procedure or treatment is a species of malpractice that focuses on the adequacy of the disclosures, rather than treatment of the patient. Understanding the history and importance of the doctrine of informed consent, as well as the rule that is followed in your jurisdiction, may reduce the risk of exposure to this sort of claim--and also be of help to the patient.
